The Joint Commission Proposes Revision of the Environment of Care Standards
Your Comments are Needed
A Message to ASHE Members:
The Joint Commission (JC) is seeking public comment on proposed new
Environment of Care (EC) Standards. You are encouraged to seize this
opportunity to review and comment on the proposed standards.
As part of JC's Standards Improvement Initiative, revisions are being made
to each standard and element of performance (EP) as well as the rationale
for standards. In announcing the public review period, JC has stated that
"No new standards requirements were introduced in this initiative; the field
will not experience an increase in expectations as a result of these
revisions." Their specific purpose is to:
* Increase their clarity and logic.
* Reflect requirements essential to safety and quality.
* Better tailor the standards to reflect the characteristics of
organizations within each accreditation field.
ASHE supports JC's efforts to simplify and bring increased clarity to the
standards as well as the opportunity to comment on the proposed changes. The
ASHE advocacy team has reviewed the proposed changes to the EC standards,
and believes that there have been many improvements, and some duplication
has been eliminated. However, the advocacy team also believes there are
instances where the efforts to simplify and bring clarity have actually
created greater ambiguity and increased compliance expectations.
ASHE NEEDS YOUR HELP!
JC has provided a narrow window of opportunity for comment. The proposed EC
Standards are available for comment through October 31. ASHE encourages you
to review the proposed EC Standards and comment on the changes.
So what are the changes?
Every standard and every EP has been revised. Below are some of the
highlights of areas that raise concerns.
* Safety (EC 1) and Security (EC 2) have been combined into one
standard even though they are two distinct functions.
* The proposed numbering system changes the standard numbers. For
example EC 6 (Medical Equipment) becomes EC 5.
* There are numerous instances where an EP refers to laws or
regulations without stating the specific law or regulation that is to be
followed. There are other instances where the reference is not consistent
with the items addressed in the EP. For instance proposed EC 6.01.0 EP 6
deals with providing the proper environment through air exchanges,
maintaining pressure relationships and filtration but NFPA 90A is referenced
in a note for this EP.
* There are instances were notes are used to identify specific risks
to be removed or mitigated. But it is not clear if the note specifically
identifies the risks that will be evaluated during survey or even if the
list is exclusive (i.e. these are the only risks to be addressed).
* There are instances where the proposed EP appears to be in direct
conflict with existing codes. An example of this is the 4.01.0 EP 5: "The
[organization] uses fire-safe bedding, window treatments, privacy curtains,
furnishings, and decorations. NFPA 101 allows upholstered furnishings and
mattresses that do not need to meet flame spread and char ratings within
sprinklered spaces.
* There are instances where the combining or splitting current EPs
creates a scoring concern. For instance a proposed EP requiring a written
plan for implementing Interim Life Safety Measures (ILSM) has been split
into 10 separate EP's, one for each possible ILSM measure. This could create
the opportunity for 10 RFI's for the same deficiency.
* The proposed standard and EPs seem to broaden the scope of
inspecting, testing and maintaining medical equipment.
* By repeatedly explicitly using the term "written" in the new
Utilities standard (currently EC 7) there is the impression of increased
documentation requirements
* Many of the EP's in proposed EC 7.01.0 use words such as "adequate"
and "sufficient when describing expectations for the patient care
environment." This raises a concern of variation in how an organization and
a surveyor define "adequate" and "sufficient" or even from one surveyor to
another.
A Call to Action
Please take this opportunity to discuss these proposed revisions to the
existing EC standards within your organization and take the time to comment
to the Joint Commission. ASHE will submit comments detailing our overall
concerns. But it is critical the Joint Commission also hear directly from
the professionals that work with these standards every day - each ASHE
member!

Clarifications to Joint Commission/Fire Safety
Prohibitions on Hallway Obstructions
A very interesting thread of emails regarding Hallway Obstructions came
through on the ASHE Listserv recently. Our very own Larry LeForge, Dir of
Plant Services & Security at Mary Free Bed Rehab Hospital (Grand Rapids) and
longstanding MISHE Board member contributed a very clear and helpful
explanation of the current requirements for keeping healthcare corridors
clear.
Presuming your inquiry is in reference to items in the corridor, the term
"In-Use" would have the same meaning as "Attended". In Michigan, items that
are attended are allowed to be in the corridor for short periods of time
while staff is using the equipment for their work. A portable computer in
the corridor (e.g. COW) that is plugged in to be charged would be considered
unattended or "not-in-use". However, if that computer was outside a patient
room where nurses were caring for a patient, it would be considered to be
"attended" or "In-Use" because the nurses would be entering patient care
data as they worked with each patient.
Similarly housekeeping carts and food services carts are considered "In-Use"
if staff is close by. If housekeeping or food service staff leave their cart
in the corridor while taking a 1 hour lunch, that would be considered
"not-in-use".
Susan McLaughlin, President of SBM Consulting and frequent speaker for ASHE
seminars, provided some history on this issue. She explained that "In use"
comes from ASHE agreements with Joint Commission in the mid-90's. It refers
to a cart on wheels that is actively being used, such as a housekeeping or
linen cart as the rooms are being serviced, or a dietary cart as the meals
are being served. She also clarified that a crash cart is considered to
always be in use, as is an isolation cart when there is a person in
isolation in the room.
Many of the listserv contributions cited the "30 minute" criteria.
Chet Howard, Dir of Maintenance at Arkansas Children's Hospital, related his
experience with Joint Commission surveyors on this subject.
A JC surveyor once told us that if it hasn't moved in 30 minutes, or it's
plugged into a receptacle, it's stored. In a recent mock survey, the
administrator surveyor said that the item can only be "in use" if the person
attending it is within sight of it, or in the room next to it. He used a
cleaning cart as an example. If the attendant has gone on break and is not
attending the cart, it's stored, but if they're close by, it's in use.

The change requires all smoke and fire dampers installed on or after January 1, 2008, to be operated one year after their installation. In addition, for hospitals and critical access hospitals, the changes extend the time frame from four years to six years for the ongoing testing of fire and smoke dampers to ensure that they fully close. The standard changes were reviewed and supported by The Joint Commission?s Committee on Healthcare Safety and the Professional and Technical Advisory Committees of affected accreditation programs.
